Is Online Gambling Legal in Malaysia
Let’s look at definitions since this is after-all about the law, what exactly do you mean when you say that something is legal? Every land has its set of laws and it differs from country to country, if the laws define it and allow it - thus it is considered legal.
However, laws are very often up for interpretation as well and in this article I will try to delve a little into the details which nobody likes to discuss openly.
According to Malaysia’s “COMMON GAMING HOUSES ACT 1953” which was last revised in 2006 (which is a good 16 years ago, the first line states “An Act relating to the suppression of common gaming houses, public gaming, and public lotteries.”
As this was in the early years of the internet, not much attention was given to online gambling.
However a recent article published by The Star on 23rd June 2022 had this to say:
“The Betting Act is a broad-based one that bans all forms of gambling unless the company has a legal license to operate and covers telecommunications and other means of transmitting bets between customers and betting houses.”
A leading lawyer in Malaysia had this to say:
“It is worth noting that the recent High Court decision in Public Prosecutor v Multi Electrical Supply & Services & 105 Others appears to suggest that online gambling is not illegal in Malaysia, due to the absence of express provisions or laws regulating online gambling in Malaysia. “
But one thing is for certain, a battle in the courts is reserved for the wealthy and no average online casino operator in Malaysia would be able to pay the fees asked by such lawyers.
